What is the role of a lawyer in real estate?

The role of a lawyer in a real estate company is key to ensure that all transactions and operations are carried out within the legal framework.

Among the functions performed by our legal department are the following:

 1. Legal advice: Reviewing and drafting contracts of sale and property management as well as ensuring that the contractual terms protect the interests of the real estate company and our clients.

2. Due diligence: Verify that properties are free of liens, encumbrances or legal problems. Confirm the seller's ownership and the legality of the property. The registry and cadastral information of the property is analysed in order to verify the urban legality of the property.

3. Management of legal formalities: Advise on taxes and legal obligations in the purchase or sale of real estate. Managing the registration of deeds in the public registers. Processing the necessary licences, permits and authorisations.

4. Dispute resolution: Representing the real estate company or clients in litigation or legal disputes. Mediating conflicts between buyers and sellers.

5. Regulatory compliance: Ensure that the real estate company complies with current regulations (property laws, urban planning, leasing, etc.). Prevent legal problems related to real estate fraud.

In short, at Castillo Homes we believe that the role of the lawyer is fundamental to guarantee legal security in each and every one of our real estate operations to avoid possible legal risks.
